Terms and Conditions: December 2025 Giveaway to win Luxury Stay in Devon

1. The Prize Draw

  1. The prize draw is operated by Breathworks Foundation ("the Promoter"), a registered UK charity (Charity No. 1015941).
  2. The prize draw opens at 00:01 on Tuesday 2nd December 2025 and closes at 23:59 on Sunday 21st December 2025 ("the Entry Period").
  3. Entry to the prize draw is free and no purchase is necessary.
  4. Two winners will be selected at random and announced via live video on Monday 22nd December 2025.

2. Eligibility

  1. The prize draw is open to residents of the United Kingdom and European Union aged 18 years or over.
  2. By entering, you confirm that you are eligible to do so and to receive the prize.
  3. Winners are responsible for ensuring they have the necessary documentation to travel to the UK if they are EU residents.

3. How to Enter

  1. Free Entry Method:
    1. Complete the online entry form with your name and email address to receive 1 entry.
    2. Share the prize draw (via social media, messaging apps, or word of mouth) to receive 1 additional free entry. Sharing is based on trust and no evidence is required.
    3. Maximum of 2 free entries per person via this method.

  2. Donation Entry Method (Optional):
    1. Make a donation to the Breathworks Foundation GoFundMe appeal between 2nd-21st December 2025 to automatically receive bonus entries as follows:
      • • £10 donation = 10 additional entries
      • • £20 donation = 25 additional entries
      • • £30 donation = 45 additional entries
    2. Donations must be made in one transaction to qualify for the stated number of bonus entries.
    3. The number of additional entries is capped at 45 per transaction, however multiple transactions are permitted.
    4. Donations of amounts other than £10, £20, or £30 will receive entries equivalent to the nearest lower tier (e.g., a £15 donation receives 10 entries; a £25 donation receives 25 entries).
    5. Entrants who donate may also complete the free entry form for up to 2 additional free entries.
    6. All donations are made directly to Breathworks Foundation via the GoFundMe appeal page
    7. Entries must be submitted during the Entry Period to be valid.

4. The Prizes

  1. There are two prizes available:
    1. Prize 1: A 2-night stay at Rooks (sleeps 2 adults)
    2. Prize 2: A 2-night stay at Cove (sleeps 4: 2 adults + 2 children aged 5+, or 4 adults)

  2. Prize Allocation: The first winner drawn will be given the choice between Rooks or Cove. The second winner drawn will be offered the remaining property. Both winners will be contacted in the order they are drawn to make their selection/confirm their prize.

  3. Both prizes include:
    • • 2-night accommodation
    • • Welcome hamper
    • • All amenities as listed (hot tub, sauna, etc.)
    • • Linen and towels
    • • Access to EV charging point

  4. Prizes do not include travel to/from the property, food and drink (beyond welcome hamper), or any other expenses not explicitly stated. Winners are responsible for arranging and funding their own travel to Devon.

  5. EU residents are responsible for ensuring they have the necessary documentation and permissions to travel to the UK.

  6. Up to 2 well-behaved dogs may accompany winners at no extra charge (subject to Rooks & Cove's pet policy).

  7. Winners may extend their stay for an additional fee by contacting Rooks & Cove 

5. Booking Your Prize Stay

  1. Winners must book their stay for dates between 15th December 2025 and 31st December 2026.

  2. The following dates are excluded and unavailable for booking:
    • • 3rd July - 3rd September 2026
    • • 3rd - 6th April 2026
    • • 1st - 4th May 2026
    • • 22nd - 25th May 2026
    • • 21st - 31st December 2026

  3. Check-in is available on any day of the week, including Sundays.

  4. Bookings are subject to availability and must be made in advance by contacting Rooks & Cove directly.

  5. Winners are advised to book early to secure preferred dates.

  6. Standard Rooks & Cove terms and conditions apply to the stay, including:
    • • Check-in time: 4pm
    • • Check-out time: 10am
    • • No children under 5 years (except babes in arms with own travel cot)
    • • Maximum 2 dogs per property

  7. The prize stay must be taken by 31st December 2026. Any unused portion of the prize will be forfeited with no compensation.

6. Winner Selection & Notification

  1. Two winners will be selected at random from all valid entries received during the Entry Period.

  2. The draw will take place on Monday 22nd December 2025.

  3. Winners will be drawn in order (first winner, then second winner).

  4. The first winner drawn will be offered the choice between Rooks or Cove. The second winner drawn will be offered the remaining property.

  5. Winners will be announced via live video on Monday 22nd December 2025 and notified by email by 5pm GMT. The email will either come directly from [email protected] or as an email notification from GoFundMe. 

  6. Winners must respond by 9:00am on Monday 29th December 2025 to confirm receipt of their prize via email and (for the first winner) indicate their property preference. If a winner does not respond by this deadline, their prize will be forfeited and an alternative winner will be randomly selected.

  7. The Promoter's decision is final, and no correspondence will be entered into.

7. Prize Conditions

  1. Prizes are non-transferable and non-exchangeable.

  2. There is no cash alternative to any prize.

  3. Prizes cannot be sold or offered for resale.

  4. Winners are responsible for any additional costs not specified as included in the prize.

  5. The Promoter reserves the right to substitute any prize with an alternative of equal or greater value if circumstances beyond its control make it necessary.

  6. Winners must comply with all requirements and restrictions imposed by Rooks & Cove.

8. Data Protection & Privacy

  1. The Promoter will collect and process entrants' personal data in accordance with UK data protection legislation.

  2. Personal data collected includes name and email address.

  3. This data will be used solely for:
    • • Administering the prize draw
    • • Contacting winners
    • • Communicating about Breathworks Foundation activities (if separately consented to)

  4. Personal data will not be shared with third parties except as necessary to fulfil the prize (i.e., sharing winner details with Rooks & Cove).

  5. Entrants may request access to, correction of, or deletion of their personal data by contacting the Promoter.

  6. Winners agree to participate in reasonable publicity related to the prize draw, including the announcement of their name, if provided.

9. Liability

  1. The Promoter accepts no responsibility for entries that are:
    • • Lost, delayed, incomplete, or corrupted
    • • Not received for any reason
    • • Made via unauthorised methods

  2. The Promoter is not responsible for any technical failures, network issues, or other problems that may affect entry or participation.

  3. To the fullest extent permitted by law, the Promoter excludes all liability for any loss, damage, or injury arising from participation in the prize draw or acceptance of any prize, except for liability that cannot be excluded by law (such as for death or personal injury caused by negligence).

  4. The Promoter is not responsible for the quality or suitability of the accommodation provided by Rooks & Cove. Any issues with the stay should be addressed directly with Rooks & Cove.
